    Correct. It is a bill that was signed into a law. Though USCIS follows AC21 in form of Memos, the law is binding and that's why we see that AC21 always works . It cannot be compared to the new h1b memo.

    There seems to be no pattern among recent approval rate-My coworker didn't get any update from USCIS- he directly got his physical GC on 4th Sept.
    We are still waiting, tried InfoPass, Raised SR, Contacted Senator etc.etc. I am willing to go to Lincoln,NE if that is what it will take to get GC:D

    do you think some sort of campaign would work in this case? may be this is TOO EARLY to think about this but that's what happened last year - we waited for 2 months and got NADA !!! Hope it doesn't happen this year.

    I agree. Atleast word "Legal" was spoken. I am confident Democrats are well aware and once they come in power they are gonna clear all mess. These all artificial backlogs could not have been created until asked for by some one with political clout. USCIS is just a puppet. Our cause of problem lies somewhere else.

    I hope Republicans don't come to power again.

    We have to keep doing this... Senetor Obama mentioned 1 line about fixing Legal Immigration process, also both Senators mentioned that ILegal Immigrants will be last in the line of the process so that is a huge progress for us... These candidates have an army of people working for them, they do a lot of research go to forums, go to debate websites to see what are the pain-points, if we can get our questions in top 10 in every debate now on then Legal immigration will be in the spot light, that is half the battle won... regardless who is chosen by voters they will all have legal immigration on their agenda.     Very true. Also members should stay away from promoting one presidential candidate versus other. How does it help our cause? This has nothing to do with free speech. There are so many other websites for such discussions.

    Though I agree wholeheartedly that this is not a platform for supporting any of the candidates in the Nov election, but given that more than 90% of the people who frequent this forum are not even citizens of the country and cannot vote... Even if I get hugely motivated towards any of the 2 candidates, by reading the motivational messages from other fellow posters, what can I really do ?
    I cannot vote...so how does it matter ?

    As I mentioned in one of my post not even 100 persons responded. It either means there is not much persons who are impacted by the memo or most are not interested. For many people to participate they will need to know the details and directions. But most update might be in donor forum. So I think in future IV will get good efforts from only donor members. But if enough donor members are there then that will be ok for IV to get success in any drive. Otherwise it will be tough as there will not be enough people for advocacy efforts

    But this drive might have added a few donor members. In that way it is good.

    I am in "Not in H1 and not affected" category but willing to contribute both time and money for this cause.

    Hello I got a yellow form 221(g) during my interview. Got my passport and approval back during the interview.
    Are other people in PIMS getting this yellow form/ 221(g) stating that "when administrative processing is completed in your case we will contact you"?
    This will allow me to decide if I am stuck in PIMS or something else.

    Just wondering how we can make this a paid site which works and where everyone wins. Here are some thoughts in the wee hours:
    0) Read for Free

    1) Monthly paid subscription (recurring contributors):
    a) can post without restriction.
    b) get important updates

    2) If you don't have a monthly contribution -
    a) Your first 5 posts are free
    b) After that you can buy "points" to post on IV (say minimum chunk of 25 points for $50 bucks).

    To post a message, it costs you a point. If you have a question, then a couple of bucks is a small amount to have your questions answered. However, without incentive people will not answer questions (because it would also cost to post responses/experiences). So, lets say I post a response to your question, then if you (or any member who posted before me) thinks that my response was useful, and adds value to that thread, can give me a "+" which adds to my chunk of points.

    This way, only people who have serious queries will post their questions, and those who are confident about their answers will post a response. It will reduce noise on the website and will become a better resource of information. Unfortunately a lot of good stuff gets lost between people venting their frustration and providing incorrect advice.

    Ofcourse, we can make certain threads free to post - such as the funding drive, media drive, state chapters etc.
    If you really really want lots of responses to your questions, you could also sponsor a thread - say $25 bucks where anybody can post a response for free, for a limited time.
    Also certain threads can be made free to post on popular demand.

    I am still debating whether to call in or to write - but I will definitely do one of the two. I just read the other thread linked to by 'internet' above & thought I would say a couple of things to the losers at alipac who worship racists like tancredo and lou: Don't distort this thread's message - we not are trying to gag Mr.Lou however much I puke everytime I see him spewing venow on 'aliens' -and I sometimes even admire his constant state of outrage and complete lack of shame.     following few more reasons may be added.

    - When a new employee arrives his/her knowledge of immigration matters is quite less and doesn't intend to take risks of going against the employers wishes. This is being exploited by many employers by way of threatening to cancel H1, intimidating that they will have to return back, instilling fear in all ways and means in the employees about the negative aspects. This leads the employee to think and step back in going against the employer.

This could be either through forums, websites or even an official supplement from USCIS which should be handed over to the employee when his H1 is approved. ( It could mention and clear all myths officially by USCIS). This instills courage in the employee to question the employer if not go ahead with law suits. Also, this even may reduce threatening by the employer.

    - Further most of the employees want their career slate to be clean without any law suit, dots, etc until their life is secured by way of GC approvals or some form of assurance from the Govt. This makes them step back on taking action against the employer.

    Soln: Well if there could be a system where anonymous complaints/whistle blowers are allowed, they probably may come out. However, rarely employee wants to reveal his identity though he suffers.

    - The immigration matters are so complicated with so many RFE's people are scared to add another their event to their history. Any transaction with USCIS is kind of a risky feel for the employee.

    Soln: This feeling should be removed.

    - immigration decisions are uncertain so people want to be cautious in taking bold steps.
    Soln : There should be assurance from USCIS that provided everything on the candidates side is good that his GC will be approved. If an employee believes that based on his/her good credentials in all respects they should assured be of a GC, they may come forward to fight against the erring employers


    Soln: How do we make employee believe if everything is right on their part, an appropriate decision will be taken by USCIS. People still dont have confidence in USCIS decision making process.

    - And for GC applicants, they fear anything against the employer would affect their GC process. At every stage (Labor, I 140 and I 485 ) they are being exploited in one or the other way. Always it the employee who is at the loosing end. I have never seen an empoyer loosing because of an employee...
    These are some of the thoughts...

    Juist to prove the original posters point about IV being intolerant about different points of view and the trigger happy attitude of some members about giving a red dots just because someone else speaks his point of view - I got a very personal and abusive remark with a red dot just for my post above. Not that I really care about Red or Green dots. My GC journey is over. This forum helped me a great deal when I was waiting for my GC. Now I am hear to help others with what I know in their GC pursuit and help with any on going action items. Just wish some members here would grow up and learn to live and let live! :)

    There is a chance that all unused visas over the last several years will get assigned to FB quota and EB folks will loose all those visas for ever.
    There is nothing in it for us. In-fact, if this bill passes, they are goin got apply the unused visa numbers towards FB, and we will lose any chance of re-capture, for-ever.
    I think, we have a lost cause. The sooner we accept this, the better. We simply do not have the funds, commitment and political support that the illegals enjoy. We all know where the maximum nubver of FB immigrants are from, and they represent a big block of votes, since most of them happen to have the herd mentality, due to lack of education.

    We, on the other hand, are educated, well read, tax paying people, who actually think about issues and merits of a person, hence no use to politicians.
