Thanks for all the analysis of the Frist's and Specter's Bill. For some people including me who is not all that familiar with all the immigration terms as others in this forum are, can someone tell me if Frist and Specters bill enforce hard country limits? or remaining visas from a perticular category E.g. Eb2 or Eb3 will be used for people without applying the per country cap?

Its unfair that we are still stuck in 2001 and EB2 has recd two year advancement. I mean something has to be done to ensure that we are getting a fair treatment...

Employment-based adjustment of status.

Just to try the tool out, I changed my PD to Jan 2005 (my EB2 RIR PD is 2005 Jan and Perm EB2 PD is 2006 Feb - but I dont know if my case has been interfiled).
According to FOIA data and the tool, for me:
"Your position is 2587 in the Green Card Queue based on your Country of Chargeability "India", Priority Date "Jan-05" and Category "EB2" .
Your Expected Date of Adjudication is Aug, 2010."
But if there are 2800 visas available for EB2 India annually and the new visa numbers for 2010 become available on October 1st, given that I will current in October, assuming no further processing delays, how come my expected date of adjudication is Aug 2010?
What is it that I am missing here?
Is there an assumption that USCIS would be adjudicating only about 300 cases per month (only 300 visas given out to avoid wastage?) and my number would come only in August?
I am taking my case only as an example, but question is general.

I know lots of cases who have completed the same degree and they all got Green cards, In fact mine is also the same but a 4 year part time degree ( officially ) and my company has filed I-140.

Hi Sivaji: I assume your friends are also Diploma+3 years full time Engineering. Do you know if your friends got their approvals via EB2 category? I don't think you will have any problems. IMO, Diploma+4 years part time engineering degree goes better with these INS officers compared to Diploma + 3 years full time engineering.
The main problem is whenever they see 3 years transcripts instead of 4 years transcripts they immediately raise a red flag due to this whole confusion with all other 3 year Degree folks.

I personally feel that core members creating a "stay tuned" thread that moves nowhere looks a bit disingenous. In any case even if things are in the works this thread may have been a bit premature.
Waldenpond's posting about the requirement for funds could surely have been placed directly to the forum as it is definitely an important and genuine post.
Anyway I am keeping my fingers crossed hoping against hope for some movement. Would be interesting to see where this thread ends.....

Checks have been cleared within 1week of RD.
Actually I sent them in June 1st week, they took 1month to return my application stating signature missing. Had it been like they did a preliminary check and returned it right away, I would have saved 3 weeks.
I already bought 3 tickets for India for Oct 8th, I am getting worried now.
Anyone with TSC got it recently?

I am the one who requested Attorney Matthew to write about this issue. I am very thankful of him to bring this issue to light as he is a very busy attorney and he still made some time. You have to file "delinquent" FBAR for prior years 2007, 2006 etc. and explain to IRS why you did not file (ex. not aware of the requirement). If needed amend your tax returns for those years to include undeclared income. This may seem like overkill, but when it comes to Citizenship time, you want to have all your tax issues straightened out.
I have filed FBAR since 1999, only now there is a lot of press about it and IRS is focusing on it. In 1999, 150,000 people filed FBAR. In 2006, 400,000 people filed FBAR. So compliance had increased due to IRS threats. I can bet you that a LOT more than 150,000 people had overseas income in 1999 :) The law is not new, just being enforced now since the US Treasury is broke !

Well I have a good friend of mine EB3 INDIA also whose PD was October 1998 ie 3 yrs before my PD of August 2001. He finally got his GC 4 months ago in June 2008.
f) If you EB3 India by the time GC process is done there is 80% chance you will be either 1) diagnosed with Blood pressure medication before you get GC 2) become a religious fundoo 3) dont give a rats ass anymore.
