    I do not mean to be negative, but this immigration debacle does not seem to end. How long do we have to freaking endure this nightmare? IV has been trying for months now...When do you think we will have immigration relief? Are we just going to end up being like thirsty deers in a desert chasing a mirage in search for water?

    I wanted to add a few points again - after reading the previous posts from Alien2006 and Chanduv23.

    To alien2006' posts I want to add the following:

    Funny how many of us have noticed the flow of suggestive ideas that we are given right from the time we start the H1 process - back in our home country:

    1. Prospective H1 employer suggests the following (nothing in writing of course):

    "Great. You are very smart and deserving. We have choosen you to be one of the lucky few whom we will take to America this year after filing your H1-B visa. Once you land there on the H1-B visa, everything will be great. You will have a job in a few days with one of our clients (Buzzer - this is one heck of a lie - there are no confirmed jobs - one has to go through the whole process of interviews again to find a project where you will be accepted on a contract position. Rarely I have seen H1 companies who have projects of their own for their employees...but no one tells us that!!!). After you have worked with us for about 6 or 7 months we will file your green card and you will have your green card within 3 - 4 years. You will be all set with the wonderful American Dream in less than 6 years which is the validity of your H1 visa!!!. (Buzzer - One more great turd of BS - Yes they will apply our green card...BUT they may or may not pay for it...they will apply but there are 195,000 H1s and only 7000 Green cards per year for India - guess what MOST OF us will only dream of a green card and may never get one).

    Folks here shout at us about why we "expect" to get a green card when we "know" that we are here on a temporary H1 visa - WRONG - we know that H1 is temp - but we also are made to think that H1 is the first natural step towards a green card. Once we get here its a big wake-up call after about couple of years on how false that premise is.

    Also - if we are "temps" no one - employers, for that matter - any organisation that we come accros in our "immigrant lives" here in the US try to highlight that YOU Are TEMPS...WE JUST GOT YOU HERE TO BE A TEMP WORKED, EXPLOIT YOU IN WHATEVER WAY WE CAN, MAKE A QUICK BUCK ON YOU...and then put you on the sinking broken boat called "GC process" and forget about you!!!. No wonder we think we think that we deserve to a fair and simple GC process - but it should be made simple and fair - coz thats the sublimal message we have been dumped with for the past 6 or 7 years...its now time for them to come through on their promises.

    To Chanduv23 post - Yes I agree things are much better now...in the last 10 or 15 years....and probably thats the reason more people want to come here and work here...I know I love my job, the people here and the whole way of life here.

    It's not just 180 daysd before the application, it also includes 180 days AFTER the application.

    This is the current section on 90 days period


    (E)(i) In the case of an application described in clause (ii),
    the employer did not displace and will not displace a United States
    worker (as defined in paragraph (4)) employed by the employer within
    the period beginning 90 days before and ending 90 days after the
    date of filing of any visa petition supported by the application.

    And the ammendment in the new bill

    (1) NONDISPLACEMENT.--Subparagraph (E) of such section 212(n)(1) is amended--
    (A) in clause (i)--
    (i) by striking ``90 days'' both places it appears and inserting ``180 days'';


    Yes, that is my understanding at this point based on the language . As soon as the bill goes into effect, you will need to stop working at the client site if the bill passes in its current form AND you are working as a FT employee (w-2) of a mere placement company (aka agent or desi consulting). If you are an FT employee of big consulting company then until they get waiver for you AND your current client proves that no layoffs were done at the client site in the last 180 days, you will need to stop working.

    All those who are questioning my profile details please check the public profile of mine. It has more info than most of you (Mr.internet) have in your own. To those who are calling to close this thread - Already someone modified the poll and added two new options, I won't be surprised if it is closed. If it is it will only show how fake some of you are when you talk about a few reasons ( not all) why GC backlogged should be solved fast.
    Someone wanted the moderators to ban me. Tell me why I should be banned? Do you say you just want everyone to only listen to what you say and what you want them to do? You can't tolerate others' opinions and thoughts?
    I am here in this country on H1B since 2000. I am also one of you waiting in this endless queue for my GC. I am also like one of you trying to get my GC fast. But I don't like to lie or twist facts for my convenience.

    Thought for the day "Walk a mile in the shoes of an American before you ask them to beleive what you say"

    MBA is not about just learning or knowledge. (atleast that's what I saw in the business school). If you really want to know about finance, strategy or economic courses, it is already available in Sloan open courseware website. MBA is about networking and meeting the right people (even if you dont know anything) who can provide leads and opportunities in future. It also helps if it is from a top university with great alumni. I did go to a top 15 school flextime. Did it really help me ? Personally No. But it did provided me with a foot in the door for many opportunities. If you are H1B not looking to get a GC then I would risk it and go for full time. If you have a greencard, then I would risk it again and go for full time. But if you are in the middle of the process and want MBA to help your future growth and if you are planning to do part time, it is a long shot. Most of the part time programs don't really care about their students with respect to career opportunities and they all cater towards full timers. (Those are the statistics that is widely published in the news) It is a cash cow for the university. So the only odd man out is entreprenuership. If you are lucky you will be make it with the first company. But serial entreprenuers will eventually succeed in the long term. My advise is to go for a full time program with a top 15 school, I wish I should have done in top 5. Again there are lucky ones who can make it big even with a lower school, but the odds are slim.

    Experience made me a little pessimist :confused:

    We should update the question in the poll and make it specific only for people who live in and around of bay area, else the 'no I cannot attend' will be from all IV members who have no way to attend since they dont live in the bay area.

    At this point, I am assuming that everyone that said "no" its because they don't live nearby :)

    Moderators, do you think it's possible to issue an email receipt to contributors? I donated $250 so far and the first $100 was done through my bank billpay.. However, the online billpay deducted the amount right away, and it didn't give me any indication whether the check was actually endorsed by the intended recipient on the supposed delivery date.. Worrying about that, I sent in my second contribution via paypal.

    Writing an actual paper check, I would see a copy of endorsement online, or using paypal I would know it's cashed out via email. But this is not the case with my bank's (bank of america) online billpay. Thanks!

    Agreed getting a GC is a painful process not to mention the bureaucracies that go with it.Agreed serious lobbying is necessary to bring about a change in the legislative system coz waiting for years to get ones GC is plain ridiculous.But the idea of REVERSE BRAIN DRAIN is just a myth.I am pretty sure that atleast 80% of the people are just average Joes whose intellect is just better than those blonde babes of the "Girl next door" reality series.We should be glad that we were raised in a foreign country lest would have replaced those poor old folks saying "welcome to wal-mart".So lets stop talking about reverse brain drain and atleast not try to replace those intelligent ones back home. We being here is best for our country and our economy.

    I am with you. We like to invent all possible reasons to try to show our importance to America, but it is obvious that reverse brain drain is not a real thing.

    American will do just fine without all the foreign programmers (including myself) living and working in this country. They can find Americans to do the work or if not, they will offshore jobs. Either way, life will go on as before.

    Foeign born programmers are not here because they are exceptionally bright, they are here because they could get a college degree and get trained in programming skills at a cheap throwaway cost, which is harder for an average American to afford. So the foreigner gets to write programs while the American has to settle for a sales position in Best Buy.

    What America really needs; what they cannot do without are the maids, landscapers, construction workers and janitors. The politicians who have to make the decision of sending out illegals have to deal with the problem of not finding maids and gardeners for their expensive homes (their wives are not going to let them do that). Easier for them to let the illegal issue prolong while they enjoy the benefits of cheap labor providing by illegals.

    The GC system is entirely in our favor. It really does not benefit America in any significant way. The fact remains that we still end up stealing their jobs at some level - whether we are willing to admit it or not.

    I am married too, but i only said that there are other easier paths aswell.

    Regarding working late, i am a fulltime employee with H1-B and never came to office before 10:00AM and stayed after 6:00PM and never ever worked weekends. Mine can be an exceptional case, but what iam saying is, your relationship with your manager is important. This can make a lot of difference in your lives.
    As long as you deliver what is expected of you, you can even work 4 days a week and get paid for 40 hrs per week.

    I think we are deviating. But allow me to say this. The point that logiclife made VERY largely correct. The other point that you made just now is true as well. Your relationship with ur manager sort of defines how well you wud do. But then that makes ur h1b/Gc process "manager specific" ;). Plus you and I are lucky that we dont work long hours like some others, but the average H1B worker does. Like Logiclife said, it may not be coz the employer forces you to, but you do it anyway to make yourself more useful and avoid layoff issues. I am sure most of us at this stage are more worried about losing our jobs coz of H1/GC problems than actually finding jobs or having no savings.

    Someone pointed up above that some say having a GC is better and some say having a Job is better. Here is what i think. If you have a GC atleast u can find another job even it takes 2-3 months. If ur on H1b you CANNOT. About the savings, well that is an individual thing. Some save more and enjoy a little less, some enjoy life more and save less.

    About whether immigration is a right or a privilege. Right now i think it is more LUCK than either one.

    I support this idea to have a funding drive to help Aman recover his financial losses. We can never thank enough for the time and effort that was put in. Its a pain we need to share. Celebrating and saying thanks to IV is nice. But contribution is only way to say thanks. Think about it if we had to file with new filing fee, we would have paid 3 times what we paid now. Its amazing and we are fortunate to have people like Aman, logiclife and other IV core have such selfless and sacrificing nature.

    you would probably not want to advertise that .... anti's usually have trolls out to get this info. state chapters should be the route to go on this.

    I suppose it would help if IV core team would discuss with members about their target contribution and percentage of goal being met. i know it might not be possible to give out the extact numbers but we can always have a percentage % on the site showing how much more is needed. This will also energize active and non active members and give them something definite to work towards..
    Just my two cents!!!!
