My status shows case recieved and its pending, but for my wife, its this status despite the fact that we she got her fingerprinting appointment.
I have appointment with my attorney tomorrow to discuss this. Will update with what she says.

If it is your home address you are talking about, then the RFE is very likely unrelated to the address change.

With so many people changing jobs using AC21, not only IO, everyone in USCIS will be aware of it. Let's discuss something other interesting topic rather when 180days start/end.
IOs will see your I-485, use some calculator/software to find out of 180days and then say pass/fail. End of the game.

Back when the July VB was first published, even the birth registrar in my hometown knew about the dates becoming current (when tons of parents all landed up in his office within a day or two, trying to get certificates for their children here :)
Airline folks who used to see a few APs here and there, are now going to be seeing a lot more people APs.
HR folks are going to be more familar with AC-21 and EAD...

I have two passports one with H4 Visa stamped and another Surname changed. While entering US, I have used my name as in the Visa (new surname) in the I-94 card.
I have applied for H1B with new surname in this May and change of Status with that I-94.
During H1 processing, I have travelled out of US and while entering back I have used old surname( as sometime back DMV ppl told that the name on I-94 should match with H4 Visa)
Now I got H1 approval and COS approval with my middle name taken as first name and new surname.
1) First thing is, the I-94 on COS approval and I-94, currently present in my Passport does not match.
2) First name and middle name are interchanged in the passport and H1 approval.
Is this going to create any problem while applying SSN? What are the possible consequences..
Also, any similar scenarios, plz respond..

The fear is of USCIS rejecting the secondary application (due to insfficient evidence -wedding certificate)
My wife cant leave the country as I dont hold a VISA now........I have a GC. Without both of us going to India we cant possibly get it as we never registered our wedding. She cant leave US coz we dont have AP and even if apply for AP now (which we ll do) it will take 90 days to get AP.
If USCIS rejects the application we ll have to leave US even after I have got my GC and I dont know how long will it take for my wife and kid to get GC once we are in India.

why - only tier1 & tier2 ? should be based salary withdrawn- isn't?
GC quota should be based on skillset(1,2,3), not solely based on salary.(remeber, we are talking about future salary here).
There should be a separate quota for Master's degree holders with existing jobs in their field of study. That would weed out people joining random schools for a Master's degree just to be part of that quota.
They should work atleast for 3Yrs(1st H1B duration) after OPT, in their field to qualify for the new quota. If they change the field during this time, they have to come and join our line.

Hi Folks,
I had been to canada to get my Visa stamped for my 7th in March'07. At the time i was entering United States, the immigration officer did not issue the I-94 to the validity of visa since my passport was expiring on Oct 27th 2007. I have a valid visa until April 2010. The I-94 attached to my passport is expiring on Oct 26th 2007. Do i have to renew my I-94 without fail? Or should i just an new I-94 next time i go out of the country and come back?

I was hoping that AILA would ask questions on capturing unused visa numbers and EB visa usage per year from USCIS!
I dont think USCIS can make a decision on capturing unused visa numbers. It is a directive that has to come down someone higher up, the president maybe. So AILA cannot ask them that question.
About annual wastage of visa numbers, since Ron Gotcher bought this news out, it must have already been discussed in an earlier [but recent] meeting or perhaps Ron has his own channel.

they are here since july last week..so around 160 days this year and were here last year for 3 months, so one-thirs of that is 30
so have a total of 190 (which is more than 183)

I received IRS tax audit check for year 2005 last week. I guess mostly I can defend my audit and I have scheduled an appointment with IRS tax manager for next week
However god forbid if I have to pay penalty on audit,I was wondering this would impact anything on my 485 process. Does it have any impact

Most audits are routine, once you can back up your claims with paper records/receipts you will be OK, but consult with your CPA and be ready to address the points raised.
Unless you have been found to commit criminal fraud, it should not affect your green card petition. Small penalties and the like have no effect. Last year I had to pay a small penalty because I underestimated my taxes deducted during the year.

Looking at all the things, it looks like August bulletin would be the best bet USCIS have with some cutoff dates but keeping the already filed apps.
