I completely disagree..There is this huge debate in IV about EB2 & EB3 IN. Everyone is looking at the dates and predicting that EB2 I will be current sometime in '09. This is perceived as injustice to EB3. What people don't realize is that USCIS is not processing. What good is a forward movement if there are no tangible benefits for folks who have already filed AOS.
Forward movement in Sep VB magnifies the USCIS inefficiencies. Despite the rhetoric on the board, this is -ve development in my view. Empirical evidence suggests that there are 1000s of cases pending for pre 06 EB2I & C and yet USCIS could not get that back log cleared. They obviously could not process enough to exhaust the available visa numbers and thus the forward movement by DOS.
This bodes well for CP filers…good for them.
USCIS is trying to make EB2 all countries Current sometime during FY 2009. Of course "a few" 2004, 2005 cases will still be pending past Oct08 but hopefully not too many.
If EB1 and EB2 are shown as current soon, then the DOS can transfer the so-called "spillover" into EB3 ROW, then into EB3 IN & CH.
Based on available numbers, EB3 India / China will see rapid movement in dates April 09 Visa Bulletin onwards.
What will happen during 2009 in all likely hood is the following,
Almost all EB1 spillover will go to EB3. (~ 25k)
Some of EB1 and all of EB2 spillover will go to EB2 IN/CH (~ 10k to 15k)
In 2009, there will be no more Name Check delays - therefore expect rapid EB3 approvals after April 09.

Hello,
My application also returned for the same reason (no I485 receipt notice attached) from Phoenix. Not sure what to do at this time. I never received I485 receipt notices. Hence, I have attached biometric notices in place I485 receipt notices. I have added a cover letter requesting to expedite the process. I am not sure if this request caused some mental disturbance on the person who is supposed to work on my application and may have sent me rejected notice.
I got my wife's and sons entire packet back with the exact remarks, "Incorrect Check amount and no I 485 attached". I had both correct amount of 340.00 and Copy of I 140 attached..I e-filed on June 15th again and waiting to see this time what excuses they come out with now..I did get the receipt notices for both of them yesterday.. What a joke??

Dear Core IV members. It is clear how tirelessly you have worked, let alone the time and money you spent, sitting in tht comfort of our homes and using our credit cards to make a small contribution of 200 dollars twice or thrice is pales in comparison to what the core mebers have done. Look at things you can see..we came on shustermans newsletter this month, we came on NBC nightly news,.. and dont forget there are things which are happening that we cannot see. Appreciate the core team with words, please donot doubt them, without them we had nothing, anything is better than nothing!!

Got the status update email from USCIS stating a card has been issued for my 485 application.
I am not married yet. What are the implications if I get married to a citizen of india residing in India.
Kindly refer me to appropriate material if you know of any.

Surprised to see that you were unware of this. Getting GC is painful process as we all know. There are three situations
1) Don't file I-485 till you get married. Risk, you might have already used 6 years on H1.
2) File your I-485 and get quickly married , then you can add your spouse. Do a court marriage in US and later you can do a marriage ceremony in India.
3) File your I-485 and get green card with out having chance to add your spouse
Since you fall in category 3, your situation may be worst.
Couple of options
1) If the girl(or guy :)) is in US, absolutely no problem. Only thing is if girl is already in US, you will get lot of family pressure from girl side.Have to compromise on lots of things. May be will become a house husband.
2) Girl from India, now you have to find a really smart girl who can get admission to universities or pass TOFEL GRE etc with flying colors. Then long distance affair starts. Girl in city X studying guy in city Y. Meeting once in a month. Lossing lot of money on commute and mental peace.The girl will have now her own friend circle and over period of time she might start liking someone else. Based on real situations.
3) Move to Canada and apply for Canadian citizenship. That's easier to get and easier to bring spouse there. But again you won't be able to bring her to US
4) Wait for 5 years. Who will want to wait for you 5 years.
Best Option
Return to your home country and enjoy life there. Believe me you won't have never any regret in life. It's just not worth for all the pains and miseries it bring in one's life. GC : Grievance Card.

I am the July 2nd filer as well. It took me quite some time to figure out the case numbers on back of the checks. All start with "WAC" means California Servcie Center. After I entered my cases number each of each (total 6 of them, 3 for my wife and 3 for me). On Sept 13. there was LUD on all of cases. but only the contents differences were appeared on two 485 cases. It said that "we transferred this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our LINCOLN, NE location for processing because they now have jurisdiction over the case.".
That is what I got so far. May God with us all!!!

I tend to agree with you. Projections by DOS seems to be closer to reality.
I would stay conservative contrary to many other predictions.
1) China moving to Nov 2005 is a good thing for India. This means India will get all the remaining fall-down/fall-across numbers until priority date reaches Nov 2005. After that both India and China will share and move the dates by a month or so. This should get India to Dec 2005 to Jan 2006.
2) Many see the dates have not moved much for so many months. So they can be skeptical about the date movements in the last few months. The reason why i anticipate much larger movements in the final months is due to the fact that India gets about 3 times more visas through fall-across/fall-down than what is alloted for just India.

We got our EAD in the mail today - We are late June filers (29th June) and got our receipt numbers last week, - I have some q's-
-Can one get EAD without completing FInger printing? In the finger priniting colum on the EAD it says - not available, Would that matter?
-How does one activate his/her EAD?

I applied for my first 3-year h1-b extention last October.
My H1-b processing or the receipt date is Oct. 26, 2006. The USCIS website showed that California Processing Center are currently processing cases for the date of Jan 13, 2007.

I went to the immigration office in downton Los Angeles by using the INFO Pass to find out the case status. All they can tell me is to wait. I asked them as if i need to pay for the premium processing fee and the official told me it would not make much difference.
I wrote the letter to the California Processing Center to find out as if my case is pending anything or if i need to submit additional information . The reply i get was the center is no longer accept any request through mail?
I am getting so depressed as days go by because i do not know what else i can do.
Can someone please give me some advises?

I have a total of 15+ yrs exp in the IT industry out of which 8 yrs in USA. I am also an EB3 :) BTW I have a 4 yr engg degree from a small college in india :p

I am totally pissed off with this system. The only wrong step which i took was applying in EB3 when i had three years of experience. Now i have a total almost 10 years experience in IT and still waiting like an illegal immigrant for GC.

The FBI name check is not a side problem that once we finish fighting other problems, let's come back and pick up another problem. This is one of the major obstacles in the GC and Citizenship process which unfortunately is not transparent and there is no data available to tell you when you will pass this obstacle. If the attitude of some of the members in this organization is the delay in FBI name check is not going to happen to them and it is only random and a side problem, think again and watch out for what will be coming your way. By no means, this is not a side problem, this is one of those hidden obstacles that you don't know it is in your way once you hit it...and once you hit it, you are stuck. There is no congressman, senator or individual to help you. If we are going to be united and make the GC process transparent, we should not hand pick some of the problems that we want to fight today and come back to other problems later. You are going to soon realize how gigantic the delay with FBI name check is.

My EAD is already approved before FP.But I didn't receive the physical card.
