There is a very clear distinction b/n Legal and illegal immigrants. He loves chinese food, indian food. He never says he does not like other cultures. What he says is that others come into this country and try to claim that it is their own country and start doing things the way they want to do. But legal immigrants for the most part are different they come here and play by the rules. they speak english, they love america and that is the reason they stay here. I think it is very important to talk to him and see what his stand is on this. It does not hurt. It is tough to get thru' to talk to him and hence I posted the message here so that others can also try and may be one of us will get to talk to the guy. If we just stick to the IV talking points and tell him we love america and of course are english speaking ( we are definitely not lying) he will be fine.
I would not recomen contacting Mr Savage. He does not appear to be the person that would help our cause.

Hi, here is my case information
I-485,EAD, AP applied on 24th July, RN received today,PD May 2004 EB3, I-140 already approved
2nd labor in PERM applied in early 2007, got it approved in May 2007, I-140 applied in PP in June and approved with the same PD as EB3 I-140 i.e. May 2004
Now, my attorney is going to iterfile my EB2 I-140 today and according to him, my I-485 file should be updated in 3-4 weeks. Has anybody got it done before? If yes, please share.

My point was that it doesn't matter. It represents $1000/ per person, hardly enough to make a dent in poverty. We need sensible labor laws, a pro-business attitude, and that money will return to India.

One of my colleagues got audit for two consecutive years and he received his green card last month.
I can back that one up. We received audit August 13 for 2005. Had to prove we are married & kids live with us. When called and spoke to officer she said it was an "INS flag"! Honest to God that is what she said. She then asked if we had applied in the last couple of months for 485's??? She knew all about the USCIS system and said one way of telling is if you file jointly at the same address each year then why would IRS be asking for proof of marriage and kids living there etc. She was great and confirmed they had received all paperwork. Had to resend due to liquid being spilled on copies.... Even H&R Block said it was INS based.
Then we get 4 out of 5 EAD's approved, but spouse gets RFE and it is proof of name change please resubmit marriage certificate!

The FBI name check is not a side problem that once we finish fighting other problems, let's come back and pick up another problem. This is one of the major obstacles in the GC and Citizenship process which unfortunately is not transparent and there is no data available to tell you when you will pass this obstacle. If the attitude of some of the members in this organization is the delay in FBI name check is not going to happen to them and it is only random and a side problem, think again and watch out for what will be coming your way. By no means, this is not a side problem, this is one of those hidden obstacles that you don't know it is in your way once you hit it...and once you hit it, you are stuck. There is no congressman, senator or individual to help you. If we are going to be united and make the GC process transparent, we should not hand pick some of the problems that we want to fight today and come back to other problems later. You are going to soon realize how gigantic the delay with FBI name check is.

It is a case of greatest good for the greatest number. 200,000 people - 20% of all the green cards issued last year - are in name check. Compare that with the 250K people stuck in retrogression and 200K people in the Labor cert backlog centers.

You are making an assumption that an approved petition is an indication of a valid status for the entire duration of extension. This may or may not be true after the I-140 is revoked.
It is kind of dicey...If you are quick enough you can pull it off...
You can refer to some posts up above that some people have actually done it..
Especially if you are laid off you have not much to lose and try something ...
USCIS has traditionally not taken a hard line against H1B as far as I know...

I have heard the above from a lawyer. I think there is lot truth in the above statement.
However, in teaching the Univ processes H1B and most faculty pay the USCIS fees. I have written a check to USCIS for my H1B fees. Most faculty also pay their GC dues including lawyer + USCIS fees.
I have also heard that faculty can negotiate for the Deptt to pay the H1B + GC fees.
In my case i paid for the H1B expenses (includig lawyer fees) my self , but my company re-embered the amount once i completed three months. Same with GC, i paid till now, 3500 as lawyer fees. Filling fees extra. But haven't paid any filing fee yet as i am waiting for my PD to be current. And the company is going to give me the money i paid till now back once i complete three years. After which company will pay every thing.

I think the new name check change, will help the system work FIFO.
This is what the system is intended to do.
Also, as time goes by, this will make the PD more transparent, so instead of having dreams and making wild guesses, there can be somewhat logical guessing.
I know it is not possible as it is USCIS and anything can be true.
But i am really happy for people with older PD's who have been struck with FBI Name checks.

What about the 130k cases waiting for FBI name check - I'm surprised nobody is looking at it. If this is all EB related (worst case scenario), we are looking at around 240k cases of EB category. Well, I already had an email which screwed up my mood today and now this...... time to dump it all and first enjoy the weekend :-)
Afterall, GC is just one of the many factors in life and the more you keep it at the lower priority end, the more you can enjoy TODAY :-)

What about the 130k cases waiting for FBI name check - I'm surprised nobody is looking at it. If this is all EB related (worst case scenario), we are looking at around 240k cases of EB category. Well, I already had an email which screwed up my mood today and now this...... time to dump it all and first enjoy the weekend :-)
Afterall, GC is just one of the many factors in life and the more you keep it at the lower priority end, the more you can enjoy TODAY :-)

You wont be watching the visa bulletin after 12 years as by then you have got you GC or you are back in your home country since your patience would run off by then.
Whatever be the case, its better to forget keeping a track of when the Visa "sad News" Bulletin is going to come and predict.
