Husband files 140 (assuming pending) + 485 - Primary
Wife as Dependent -
Case 5
Wife files as Primary - 485 assuming she has 140, or if not 140 + 485
Husband is not a dependent.
If Case 4 is approved then both are safe (if Hub as a better PD).
If Case 5 is current - Husband can do follow to join and get the GC

got the approval notice (welcome notice) today.
CPO email: 08/06 (online case status: Card/Document Production)
approval notice email: 12 hrs later (online case status: Decision)
soft LUD: 08/09
approval notice snail mail: 08/13

Same exact sequence for us too. CPO:8/6, Decision/Adit: 8/7, slud: 8/9, Welcome mail(snail mail): 8/13, Last Processing action/Post Decision: 8/13. I can hope by cards should be arriving by8/16-8/18. Keep posted it helps all those tracking....

Since 2004 EB2 is cleared, I am seeing less number of posts being made on IV.Yay I became a senior member, will that mean I will get a green card?

Be ready with the following supporting documents. My attorney asked the following:
1. Personal Details -
(Travel Plans in the next 3 months, Moving Plans in the next 6 months, Contact Information, Passport and I-94 info, Employment Hisotry - Last 5 years+ Last job ouside US, Residence History - Last 5 years + last residence outside US, LC, I-140, EAD and details, and a few other questions, etc)
2. Passport copies- all pages, current, all old.
3. All I-20, I-94, I-797, LC, I-140 copies
4. Birth Certificates or Birth Affidavits
5. Marriage Certificate or Marriage Affidavits -
6. Sealed Medical Exam Cover - I-693
7. 6 photos for adults ( 4 if under 14)
8. Photocopy of current I-94
9. Divorce Certificate (if applicable)
Happy Filing.

Keep up the good work
I am upto 14 letters signed, sealed and mailed to the President. I am waiting on a few more to come....It took probably an hour over the past week. Guess what...in the process I educated over 20 Americans about our issues. Guys this can have a cascading effect if we talk to people we know and get these letters. We all need to step up and actively talk to all Americans we know and get these letters. They are our support bank when its time for larger fixes and we need Americans to call their Congressman & Senators to help us.
Talk to EVERYONE you know and get a letter signed. It would be great if everyone mentioned the number of letters they have got when they put out posts on this thread. Lets not just talk the talk but WALK the TALK!!!:D

H1 Visa renewal (with a new employer)...earlier H1 visa was stamped in Toronto.
I-140 pending at NSC since March 07
Category is Schedule A (now EB3)
I-485 pending at TSC, EAD and AP approved.
There was no communication between the consulate and my employer. I guess it was just luck.

I went to infopass on Aug 31s1, when my date was about to be current.
IO told me preadjudicated and I should come back in 2-3 weeks if I dont hear anything.
So I went yeaterday. Same IO. Told me everything looks ok and case is being "moved" Apparently she saw something in the system and told me that on sep 16th, your case was "moved". Couldnt tell me moved where, but still in TSC.
Again told me to come back in 2-3 weeks to get status update.
WTF. Anyone else with similar expirience?

How can the current position (EB3) relevant when the new employer is filing your GC for a future job (Eb2) ?

Good Question. AC21 usage introduces a "Chicken Or Egg" situation. Our limitations 1) Till we interfile we have to show us fulfilling EB3 job calssification related obligations ( that also is a "future" postion in reality). Now if EB2 application is from "same employer" then that employer can logically produce the letter matching EB2 level experience after "real and natural skill progression" only to prove that you are fit for more advanced skill level job in other words after wait for 2-3 years.

in mumbai, also you need to enter the details of petition online (petition number, expiry date and petitioner name) while booking appointment.. and you need to submit all documents before 5 working days.. (in some cases they mention 3 working days)
I havent taken my appointment yet so dont know if that would be the case even for Delhi. But in Mumbai..r they asking to fax the documents (like I-129, I 797A, LCA etc) to them prior to the interview?

Now coming on to freebies,What benefit does IV provide to past contributors.I have contributed in the past, have been active at the initial stages,have spent my own money and booked airtickets to meet senators.Been a leader in a state chapter.But later realised that it was not worth for this forum which has partitions among so called donors.
Why the heck does any one want to see in a home page about posts on a donor forum.Just hide it and keep it among yourself and discuss .
Now red may follow,and a possible ban.

AP can be used to re-enter and you can continue on your H1 if it is valid. Your H1 is invalidated only if you use EAD.
I just came back to US using AP, I had booked an appointment for Visa interview. But after seeing the PIMS mess I decided to use AP. It was very smooth and easy.
