We need experts advice in the following matter.
Here is my situation, I have entered US on H-4 and after sometime I have applied for H1(Change of status) through a consulting company. I have worked for this company for 3 months.
When I went for H1 stamping,visa officer said that my case need to go through Administrative processing . I came back on H-4.
We have applied for 485 (through my spouse) and got EAD and AP.I have started working on my EAD. Recently we have received a mail from the consulate saying my H1 was denied and there was a note saying
"section 212 (a) (6) (c) which prohibits unlawful misrepresentation. See form DSL-851 for further details . ". (Not sure what triggered this?). I couldn't find this form anywhere, what is this form?
We have sent an email to US consulate abroad, asking for reasons and future steps, and we have received a response saying
"your case has been fowarded to the USCIS for a final determination. As for your H-4 visa, a decision may not be taken until the USCIS makes a final determination in your case by the USCIS."
Can you advice us what to do next?
1. Will it be possible to withdraw the H1-B application from USCIS?
2. Approximately how long it may take to get a final decision?
3. Is it better to contact USCIS about the case?
4. Will there be any impact of this on my 485 application? or on any future immigration processes?
5. Will there be any problem while entering or leaving the country?
6. Does USCIS notify us about the final decision?
7. Is it better to seek help from Senator in this matter to know what is the decision on our case?
Please advice on this matter as we have travel plans next month.

With the kind of response I saw at the House judicary commitee inspite f making all those calls . I now realize where we are on their priority list , below horses .

If you have a project, there are companies who will keep $6 hr and 10% as payroll taxes.
Let me know, if you want more details.
P.S. I am not connected with the company, but I know people who worked in that company for years.
I know of a company which will keep $2 + 10% for payroll taxes. A lot better than the one above.
There is so much competetion in this space that people have reduced their margins to next to nothing.

Congratulations on becoming a new Father. Though your name sounds as if you were the mother :). Anyway, if you got 4 interviews in 6 weeks, that sure does not look like weak economy. I remember the recession of 2001-2002. People used to get one interview in 4 months back then.
Laid off 6weeks back. Attended 4 interviews. Outof luck.
I used to get many calls from desi consultants. But not now. I do not know whether it is because of economy or my EAD status.
Here are my excuses to not to get job.
1.New Father (I was little confused about how every thing goes. Thank god no set backs here)
2.Functions(I was occupied to celebrate his 21st day).
3.Taking care of new born( He needs to be feed once in every two hours. Mother got tired of this.)
4.Holiday season.

The approval of h1 will not invalidate H4 visa. The usage of h1 visa invalidates H4 visa.
if you have h1 approved and don't join the company, then your h4 remains intact. Once you join a company on h1, you will fill out i-9 form, which informs the concerend authorities about your status change.
That's what I meant . Since he started usinlg the H1 his H4 visa was no longer valid . Doesn't that mean that if he goes back he will have to get some kind of visa stamped to come back ( either H4 or H1 ). Could someone throw more light on this situation.

...and you dont want to get a H-1B visa stamped because it is risky? What kind of risk does that involve? There is no risk. Just get your H-1B stamped when you go to your destination. Simple.
My F1 visa was rejected for no good reason long back, before i even came on H1B. So its kind of scary every time I have to go for visa stamping. Its very random. Guess its just the fear inside me.
So I guess its all about the risk, if or not I want to get my H1B visa stamped or just wait for the freaking AP.

It certainly seems like the RFE rate for supportive evidence has increased recently. Certainly for the 140 cases but also for other petitions as well. I had never received an RFE before, but recently got 2 for different petitions. An RFE always makes you a little antsy no matter how routine it is.
We are also hearing about PERM audits higher and denials also more frequently.
So far the RFEs seem to be for the common issues, like ability to pay, education qualifications etc.
It might be a good idea for someone to compile a list of typical RFEs at various stages. The rest of us can start adding for the benefit of those who get one in the future. In fact it might have been done already. I remember Logiclife putting something together during that 485 filing time in July/Aug.

My 485, EAD and AP application received in NSC on AUG 2nd. My personal checks are not redeemed yet. I haven't received receipt numbers or EAD or FP.
But the USCIS receipting times states NSC is processing receipt notice for AUG 8th.
I don't know what's going on....
Do they transfer my case to TSC??? Because I am living in TX???
My employer office is in Illinois and my lawyer office is in Michigan.
My I-140 is filed on Mar'2007 and still pending in NSC.

You will get your card between 5 to 10 days from the date you have recieved card production email, so you will have time to go India and get the marriage certificate.

We have been model "future citizens" by paying all our taxes, abiding by civic laws and meticulously making sure that we never get out of our precarious H-1 B visa status. This is how we are rewarded. This isn't a "grand bargain" it is not even an "amnesty" as many anti-immigrants are labeling it, this is worse, it is a "travesty." Bravo US Senate, you just proved that playing by the rules is such an unAmerican trait. We learn that from your grand bargain. Better late than never. So being illegal, not paying taxes will yeild you a green-card after 8 years of z-visa. How about many of us that have been subjected to endless waits, thousands of dollars in USCIS Fees, paying taxes for the last 8 or more years. Do we have to wait for another 8-10 years?. With the "grand-bargain" it does seem like it will be more years for legals waiting in line.
I like to think that being illegal is better than legal as per the provisions in CIR!
What do you think of H4-spouses who can't work whereas those illegal can now apply for a work-visas!
What do you think of parents who were not issued visitor visas for silly reasons? Whereas those who by hook or crook got here are being given work-visas?
How come the illegals are guaranteed a GC within 5 years and the current legal immigrants are NOT?
How come the illegals can work and the legal residents on certain visas can't?
How come the illegals can work for any employer while H1Bs can't?
I am not against giving these benefits to illegals if that's how it needs to fixed. But what about us, the bright and good folks!!

This is just a humour but has a meaning underneath if you try to understand. I am comparing USCIS to a product selling company. If USCIS was a TV selling company what would happen to the customers the way it acts ?
You could buy a TV but you will not know when you will get it. It could be shipped the next week, the next month, next year or never.
The credit card will be charged once, may be charged twice or a valid CC may get rejected.
Somebody who buys a TV from USCSIS a 2 years after you do, he may get it sooner than you do.
USCIS has no way of knowing how many TVs have been ordered and how many of them are in stock.
In case you do not receive your TV in two years, USCIS acknowledges that there is a long wait time for some and does not do anything about it. USCIS thinks acknowledgment of wait time is more than enough that it has done for the customers. Customers did not deserve this but USCIS did a favour to them being a good "Customer Service" company
There would be an online survey after you buy it which would never get submitted 99% of the times.
In case it did get submitted, somebody will read one out of 10,000.
After reading it he will throw it in the trash can.
If you get a defective TV (which is quite likely), you have a chance to file appeal by paying the same amount of money for the TV again so that your case can be re-opened.
I wonder how many customers would USCIS have eventually ??? Any guesses ??? :-)

1) Degrees from non-accredited colleges cannot be used for any immigration purpose (or for any other purpose for that matter)
2) A Post Graduate diploma is not enough for EB 2. You will need to do a Masters from a accredited US University. Remember, many online universities (including Phoenix) are accredited too.

C'mon dude, i wouldn't use the word "get lost" for someone who has kept cool and putting up thoughts without using extreme/harsg words. even if you suspect the person could be from anti-immigrant group, I don't think it's appropriate to sentence someone based on suspicion.

Posts like yours are welcome, they help us remember that there could be fraud happening around you and you gotta be careful. But in case you are not immigrant and the news made you believe that the %age of such fraud people among legal immigrants is significant then let me assure you that it is not, in fact work-visa community is at the top of the list of cleanest/noble communities. Their contribution to national prosperity and keeping America is # 1 is among the highest. In a way they are the soldiers with keyboards in their hands, fighting for America.

My old I-140 is still active so it was safe while porting. I am not sure what happens if the old I-140 is revoked, sorry i don't have answer for this..

So in your case, did your older employer cancel or withdraw the I - 140 or it was active. Do you know if you can still port the priorty date if the I140 is withdrawn by the older employer. I have looked at most of the forums and haven't found a concrete answer to this question.
