This brings back old memories back in early 2006. I had brought this point up and actually even written to the White House (and got the generic response back). Unfortunately back then we were a much smaller organization and not as well recognized and not as knowledgeble and as organized as now.

My wife is on F1 visa and I am hoping the dates will move soon and we will be able to file 485. I would like to know if

It is unfortunate that people don't even try to understand the issue and just go about complaining it.
Most people can't even differentiate between what is law and what is not. What are difficult things to accomplish and what are not.
It is absolutely imperative that 5882 pass otherwise the situation will continue to exist.
Here are the my estimated waits for EB3-I
PD(end of the calendar year) and its corresponding wait in years
2001 1 year
2002 3 years
2003 4 years (Bad economy in 2002 and early 2003)
2004 7 years (Case surge in 2003 and 2004 due to booming economy)
2005 8 years (fewer cases in 2005 due to PERM)
2006 10 years
2007 12 years
2008 .....
I think we are fighting the wrong fight. I do recognize the whole EB system is unfair and in particular to I/C/M/P.
The letter campaign is a great initiative, but I am not sure if we are focusing on the right problem. By saying that the new "interpretation of the spillover" is cruel to EB3 I/C/M/P is plain wrong. Both old and new interpretations were unfair to EB3 I/C/M/P.
Old interpretation resulted in good forward movement to EB3 ROW while EB2 crawls.
New interpretation results in good forward movement to EB2 while EB3 crawls.
How does EB3 ICMP benefit from both the interpretations?
EB3 is clogged because of the 245i cases. Unless we focus on the exact problem no amount of letters to lawmakers will not yield any result.
Writing letters to lawmakers is not going to provide any impact for this year Here is my reason it takes 3-5 weeks for the lawmakers to get the letters in DC because of special security screening requirements. By the time they receive the letters the Congress would pretty much be done with their term. The best option would be to meet with the lawmakers in their local office or in DC and appraise them of the long wait.
Please do understand that one of the reason USCIS changed their interpretation is because many folks with Ph D's and MS from ICMP where waiting for years to get GC"s and USCIS/DOS looked stupid in explaining the reason for the long wait for such folks. Even in the "visa wastage" hearing in the House immigration committee (on Apr 30) the DOS/USCIS was having trouble explaining the long wait times. One of the witness in the hearing was a PhD from China and had been waiting for years for his GC.
Come on folks. EB2 forward movement is good for EB3's, because EB2 will soon become current and the spillovers will be soon coming to EB3 after EB3 ROW is current. I am anticipating DOS will turn EB2 current in the second half of the year and this will ensure all the spillovers will flow into EB3's because EB2's with PD mid-2007 to now will not be able to clear the NC 180 day barrier. Cheer up folks and let us focus on the real problem getting more number of visa's through recapture.

You missed my point entirely. The better thing for everybody is to decouple the namecheck from the green card so that the name check can go on for as long as the FBI desires while you get the green card which can be revoked if the name check fails. To get a large government agency to spin their wheels faster so that some foreigners benefit in a post 9/11 world is a lunatic and impractical way of thinking.

Thanks IV. I think this is much easier for hundreds of people to participate as its easy, doesent take up too much time etc. and brings about our points across as compared to DC rally (please dont get me wrong here it was great but difficult for lot of people to attend because of various reasons). So I think we should spread out word about this as much as possible. Again, please dont get me wrong. Thank you.

I just called CS of Vonage and asked them about 5k minute limit. They just laughed as I was not the first one to ask. They said for residential Vonage world plan there is no limit. those 5k applies to business . So rest assured and call India without any fear or limit. Unlimited !

The 5000 minute limit is phrased as "consistent with residential use" term in the Terms and Conditions. CS is often clueless.

Just a quick question for current Vonage users.
Currently I use Phone Power (VOIP, almost same as Vonage). They give me one nice feature called Remote Click 2 call. What it does is, if I am in office (where there is no long distance calling allowed), I login into my phonepower.com account and click on Remote Click2Call. This asks me to enter the number where I am at, and the destination number. So I get a call at my office phone and it connects me to the destination number. And there is no charge for this call.
Does Vonage offer this kind of feature? and can we make calls to India (under their India unlimited plan) using this feature?

U are saying - The person's GC category should be same all through out the GC process, irrespective of the technical advancements the person make during the course of the GC process. A person is porting only because he is qualified for the category, U folks are talking as if there is an open slot and everyone is clamoring for it.
U'r logic should be similar to the below scenario..
A person joins a company as a Jr. Engineer, then based on U'r logic he/she cannot become a Manager (which requires an MBA / equivalent) because he entered the workforce as a Jr. Engg. Even though the fellow would've acquired necessary skills and even MBA (going part-time to school), still he/she cannot become a Manager. U are vouching that an MBA who joined few months earlier can become the Manager but not the home groomed fellow. Wow, U'r logic seems to a ground breaking thought process, please extrapolate U'r lawsuit for the case mentioned above. If you win, this might be the most ground breaking decision in US.
Personally I've reported to folks who joined company as high-school grads and worked their way up to Managerial position ofcoz acquiring the necessary college education while working. They have shown up those experience to move ahead of other folks who joined later with higher degrees.

Rather than focusing on divisive efforts why can't you focus on real problem - retrogression. Why don't you work towards IV's goals? You folks joined the forum few months back and have already made great impact. Hope you would channel U'r energy into something positive for the entire community.
