I don't have H1 backup and already in 8th year. I am on self employment, But my lawyer suggested to apply H1extension (through my company) as a backup if MTR denied. If MTR are successful they I don't have to go on through H1 hassle again..

I understand your point of view, I used to work in solar energy. When i completed my post graduation most of the jobs required a USC (this was 10 yrs ago). I had to switch to software related jobs.
For me the number one priority is how Obama will handle the Skilled immigration issues. will he guided by Sen Dick Durbin, who at the moment seems to be his policy wonk. That will be a disaster for us. They have no intension of supporting skilled immigrants. We will will have to make some serious decisions if he is elected.
How many of us want to continue to stay in limbo...i dont.

1. We all agree there are loopholes in each and every system. Are you trying to fill 1% by punishing 99% of the people. If you want to fix loopholes this is not the right place to be. Go to the court and fight with the adminstration. Why the hell you are wasting your time.
2. Considering you are a anti-immigrant, and you want to fix the system. Are you targeting Employment based immigrants or family based immigrants. Employement based immigrants are just 17% of the total immigrants whereas family based immigrants are more than 50+ %. better target them. Don't waste your time since you won't get anything as everybody over here are working and US employers want them.
3. If you are unemployed, please spend your time in findiing a job. The minimum salary in US is around 8 dollars a hour so you have wasted your entire day. close to 100 dollars. You have not earned a thing by writing your thoughts in this forum.
4. Senator Grassley and Durbin are working on your side and they also like you don't want a google, yahoo, ebay and other firms to suceed iin US. Be prepare to immigrate to some other country in future.

I received the cards today. However, the "Resident Since" date is some date in 2008 instead of 09/20/10 (date when I-485 was approved).
I was told by USCIS customer service to fill out form I-90 and mail it to them for a replacement.
I needed clarification on a cryptic question on the form-
Under Part 3 (Processing information)-
3: City of residence where you applied for an immigrant visa or adjustment of status
The I-90 instructions has this - "City of residence where you applied for an immigrant visa or adjustment of status - List the location of the U.S. Embassy or consulate or USCIS office where you filed your application for an immigrant visa or adjustment of status"
So does this mean it is the service center I applied to during the 2007 fiasco? or where I lived when I-485 was filed? The question is cryptic but the help in the I-90 instructions looks clear.
Any one had this issue before? They do have an option on the form for USCIS error for which I do not need to pay any processing fees...

It is not true that all the H1bs are creating jobs. For one example I worked in a big garment company and they laid off hundreds of people(around 800) 4 years back and did offshoring 90% with 10% H1b and L1 to Infosys. This would have created less than 10 new admin jobs for setting up office here but it displaced 800 jobs plus all the new projects(jobs) go to Infosys and US government lost millions in taxes for a private company to save a few million dollars. But if a H1b is a real innovator or investor then he could create scores of new jobs but those guys are very less. They should be identified and rewarded by faster GC process.
But real intention of H1b when it was created was to fill shortage of skills but not for competing with citizens in rate. If the real intention is to compete globally then that needs to be revealed while lobbying with Senators. There is nothing wrong with immigrants or H1b persons. Most abuses are done and enouraged by employers. Corporations prefers a person always to be in H1b so they want more H1b quota and less gc so that they can exploit people.
Basically H1b numbers and offshoring needs to be increased when demand is high(Really it was needed on 1999 and 2000) and it needs to be decreased when demand is low. Also today also there is shortage of skills in a few areas. System should handle those also.

THe reason USCIS is showing low numbers for the reason that , no one will then raise the question for recpature. Looking at the numbers they will say, O, the numbers are so low, whats the need for recapture and we will be left hanging cold and dry.

I appreciate IV's effort in getting FOIA executed and now working on aftermath of it.
For people who are angered with whats been going on in last couple of days. All I can say is to try volunteering for IV even for a month.

However can you please tell me anyone who got GC in Eb2/Eb3(India) in 1-2 yr in the last 15 yrs?
Exactly that is now 2006-2007 PD guys are expecting to happen a miracle, right? I mean, apply 485,EAD ASAP.
If you guys really care about 2002-2003-2004 guys, then please please wait for OCT 07 bulletin and after that you can do anything you want. If they will retrogress the dates, then please fight but not before that.

And we have to fundamentally examine where we are and where we want to be going over the course of this next century. And that is not happening, not in the presidential campaigns of both parties. My wife and I both have filed forms N400 in October of 2006 in Minnesota (Nebraska Processing Center). USCIS received our applications on October 10th, 2006. On October 18th both of us received the fingerprints requests, which have been processed on October 27th. My wife’s case has been approved in February of 2007. She had her citizenship interview on March 16th, 2007 and became the US citizen on April 11th, 2007 after taking the Auth of Allegiance.
I have not heard anything about my case since the fingerprints appointment. I have tried calling the USCIS Customer Service Number but they did not have any updated information about my case. I have also spoken with the Immigration Officer in the local USCIS office (InfoPass appointment) on July 27th, 2007. I have learned during that interview that my case is pending due to the FBI Name Check. The estimate that has been given to me was as long as 3 to 5 years, maybe more.
So as of now my application is pending together with 320,000 others. Well since it's been pending for almost a year now I'm a proud member of 152,000 who had been waiting for more than six months, slowly moving to join more than 61,000 lucky ones that had been waiting for more than two years. Hence my next question.
4. Did anyone hear the Name Check clearing between one year and two? Based on all of the people I've talked to it either took just a few months or more then 2 years. Seems to me once they put your file in that special pile it will not take less than 2 years.
