I doubt that there is any "transfer tax". As long as you have filed your income tax return that showed the source of that "saving" (good job there), you have already paid taxes on it. Also, your parent don't have to pay any tax on it since there can be no double taxation of the said money.

Could someone live in the US on a H4 visa and work remotely for a canadian company, travel back and forth for business, all the while maintaining the H4 in the US? Of course the work in Canada would be based on a temporaray work status in Canada. What legal hassles would this create if any? Any comments. This may be a useful scenario for spouses stuck on H4 due to retrogression (no EAD, finished 6 years on H status). Anyone care to comment?

One of my friends had similar denial. He approached Sheela Murthy, they did appeal MTR for him... later he got approved... Make sure you go with a good lawyer who can bring you out of the situation... I know, it would cost you little money but it's worth trying especially if your PD is pretty old... BTW, what is your priority date and 140 filing date?

it is defining a narrow set of applicants. Are they ones whose 485 is stuck after filing 485. or are they ones whose 485 cannot be filed and only have 140 approved ?
This means applicants that have already applied for I485 and have not been approved. It has nothing to do with the people who are waiting to apply.
The whole thing is just a big PR scheme.

There is a very clear distinction b/n Legal and illegal immigrants. He loves chinese food, indian food. He never says he does not like other cultures. What he says is that others come into this country and try to claim that it is their own country and start doing things the way they want to do. But legal immigrants for the most part are different they come here and play by the rules. they speak english, they love america and that is the reason they stay here. I think it is very important to talk to him and see what his stand is on this. It does not hurt. It is tough to get thru' to talk to him and hence I posted the message here so that others can also try and may be one of us will get to talk to the guy. If we just stick to the IV talking points and tell him we love america and of course are english speaking ( we are definitely not lying) he will be fine.

I am in the same situation right now, called both SFO and SJC airports and they seem to indicate they do not know anything about it. DVB how did you handle it ? Also, will it affect my status being on expired I-94 ?
