Most of the problems will be resolved after making legislation on the 2 options which can be easily done.
1. Remove 7% per country cap and come with more scientific number based on the H1B approvals since 2000 to get more weight to India, China, Philippines and Mexico.
2. Throw the unused numbers wide open at the end of Fiscal year based on Priority Dates. No country cap in this case.
3. Keep one Visa number per family. This one is tough to get pass through House and Senate.
The first 2 options are more feasible and can be done quietly without much political and public confrontation.

If the other guy worked for the company atleast 180 days, then your employer cannot prove that he had no intention to work for the company. If the guy worked for only a short time or didn't work at all for the company, then the company can win the case.
The greencard of the other person will be rescinded. You can then use his labor.
We dont know all the details of the case. If the person who got 485 approved worked for more than 180 days for the sponsering employer.

Yes you can do it. You could have done this last yr as well.
I am on H-1B and wife on H-4. We did not get our stimulus payment last year since she does not have SSN.
For people who did not receive stimulus payment last year can claim it this year. So for people like me whose wives are on ITIN, can get $600 back this year or so I think. The way to do this can be:
First file Married filing separately, claim $600 credit and then amend it to file married filing jointly. IRS will not ask stimulus back. Let me know your thoughts on this idea. I wish I could get $1200 but hey even $600 is better than nothing.

It makes no difference whether they allow concurrent filing of 140/485 or not IF YOUR EMPLOYER IS WILLING to pay extra premium processing for 140. IF not , it makes minimal difference (2-3 months delay). Earlier this year, people were getting 140 approved on 6-8 weeks on average without premium fee.
If your date is not current:
This rule makes 0 difference. File 140 and wait for approval while your date moves forward. Once its current, file 485. So everyone who is retrogressed, this rule makes no difference to you 485 filing and getting EAD/AP.
If your date is current: File 140, regular processing 2-3 months and then file 485. If you can get premium processing done then it would be 15 days and then file 485. Either ways, you are delay in filing 485 by 2-3 months. In the grand scheme of things, its negligible. It would take even 2 months for your lawyer to get the paperwork straight for filing 485.
So please relax, this new rule that does not allow concurrent filing of 485 and 140 is not earth-shattering. Its a revenue generation move. And its good as long as revenue stays in USCIS as they do need revenue to hire more people to process files faster, which is in our own benefit. The only problem we have is the rise in fees generates revenue which often times does not stay with USCIS and goes away to other agencies of DHS(I think, this was mentioned in CIS Ombudsman report, if I am not wrong).
SO if USCIS wants to make a new rule of filing I485 for the one whose I 140 is cleared and priority date is not current, It CAN DO That RULE Right?
We do not need any Congress approval for that Right?

C'mon dude, i wouldn't use the word "get lost" for someone who has kept cool and putting up thoughts without using extreme/harsg words. even if you suspect the person could be from anti-immigrant group, I don't think it's appropriate to sentence someone based on suspicion.

Their contribution to national prosperity and keeping America is # 1 is among the highest. In a way they are the soldiers with keyboards in their hands, fighting for America.

Every one are highly educated and highly skilled and there is always needs to be difference compared to other forums. Actually after Moderators started monitoring messages one person is putting abusive languages in comment section of the Reputation of many posts as those are unnoticed unless the person complained. I welcome red or green dots in reputation but abusive words in the comment section are not acceptable to me.
It may not be possible to micromanage everything. But moderators are taking prompt action if anyone reports abusive languages.

Its is always advisable to file the petition as AILA clearly stated that they are going to identify "class" of people. The court may or maynot give benefit for all classes .so better file and be in the "Best Class" where if AILA wins the case you will get benefited ,Dont be penny foolish as if you already spent money in getting other stuff ..what you are loosig in 1 grand for attorney fee , ( think of desi employers who gets 2 grands every month on you )

I got a email and case status changed on my wife and my I485 to 'Notice mailed to new perman..."
Is this is a legit approval? My PD was current under the Nov but is not under the Dec. When does Dec become effective?
Hopefully there are some legislative changes so everyone gets some much deserved relief

Would there be a problem as I sent an affidavit in lieu of birth cert with just my father's signature? Please let me know.

Consulare processing means, you have to go out of the country to your home country and over there you have an interview for an immigrant visa. If approved you come to the states with that visa and receive GC here. If denied, consular processing CANNOT be appealed. The decision is usually final. When you do I485, whcih is adjustment of status, you stay in the US and if gets denied you CAN appeal the decision. To be eligible for adjustment of status in the U.S. one must show he/she never violated non-immigrant status until the I485 was filed(since last entry).
If you file I140 while being on F1, that could be taken as "violation of non-immigrant" status. It is advisable to change to a dual intent visa before filing for I485. Such visas are H1 and L1.
I am not attorney so don't take my answers for granted.

We are in exact same scenario, but was thinking that H4 holder has to enter using AP to continue to use EAD after "vacation" . So is it like, Use H4 for travel and EAD to work, instead of , Use AP for travel and EAD to work? This will be of great help to many people who are scared to use AP or not want to face the extra half hour at immigration counters.

An interview does not mean approval. This is just part of CIS pre-processing cases when the PD is not current. They will interview the applicant, process it and then throw it into storage.
About 5% of cases are randomly selected for interviews. This does not mean that they are out to approve a 2007 case ahead of a 2001 case.
