I was going back through the statements that we received from the Insurance Company. The statements shows OASDI tax withheld, which is the SS tax. I believe, the employer is equally responsible to contribute 6.2% of the income to the SS and 1.45% to medicare. That means, this income should be added to the SS wages and medicare wages by the employer. I would be complaining about this employer tomorrow to IRS.

BTW, fathers are also eligible for this paid family leave in CA within the 1st birthday of the baby.

If I were you, I would not have gone with the repeat of X-ray test unless it was absolutely necessary. X-ray are very harmful to the human cells and tissues. It was a ( Probably honest) mistake by the doctor who was going to give the correct report...and you forced him to take the x-ray again!! hmmmmm....I have nothing more to say.

The language in the RFE caused my lawyer to say that, to have no issues, its always best to follow the RFE language code exactly, even if did not make sense. One should always give more data in the RFE response than needed.

NYC is pretty easy, you have to shown your passaport and you get your ID or Licensing driver application. Thank god, but what a mess! I am wondering if we are still welcome in this country, i don`t know any more....

They won't wait for your PD to be current to issue FP Notice.
Also, I don't think (my 2 cents) its advisable to travel before FP.. You never know when it will come and if you miss it... its considered as if you ignored it... They will issue one more FP notice before closing your AOS application...

I totally agree with the majority opinion here.
That IV is the best organised, dedicated organisation out there looking out for people I can identify with.
Have they done a good job? The question is the other way round. This is an open organisation. The core members are easily accessible. Anyone who is willing to contribute in terms of volunteer work, if not contribution, is more than welcome. What are You willing to do?
This is not a rhetorical question... I'm not what they call the core member.. I'm on the outermost orbit. I just contribute money (once, till now) and log in once in a while. But at least I�m doing something, and it makes me feel a little better that for a change, I�m contributing to a genuine bunch of people who are willing to make personal sacrifices for something that affects me.
That said, is all criticism bad? Here is where it gets a little tricky.
Why is that?? Lots of reasons.. About the dangers (and futility) of having a zero-tolerance for criticism in an open web-based community. Some of it, though, does provide a pointer to the complexity of the issue. For instance, one of IV's goal is to guard against discrimination against legal immigration. Queue jumping, in short. Yet, thousands of us are stuck in BEC's (Dallas and more importantly, Philly), awaiting a "labour" certificate. The whole process is idiotic and obviously there is something seriously fishy there since there has been no significant movement in years.. and everything is handed to a 'private' contractor for data entry and software development, and there is NO communication or transparency. (Yeah, you can blame my innate cynicism, but coming from where I come from, I can smell corruption a mile away - and this thing stinks!). Is it on IV's radar? I believe so, and there have been very clear and positive statements on strategy regarding this issue on IV.com. Also, I understand that the focus should be on maximising our efforts on the immediate issue, which is the legislation - especially given our limited resources.
But I would love to have it moved a little towards the centre of the radar screen rather than languishing on the periphery..

This is the sort of thing that should make folks wake up and smell the coffee. Advocate for yourself or lose the dream. Those of you hoping to wait it out, whether it be 5 yrs or 10 yrs, let this be the warning shot. When times get tough, you see all sorts of crazy things crop up, whether intended by the gov't or through vigilante enforcement like in this case.
What makes EAD holders immune to these sorts of things? Nothing is certain in this environment.
Physicians recently faced a scare(last year) when the USCIS TSC unilaterally started deeming MBBS degrees undergraduate baccalaureate degrees and declining EB2 petitions for them in spite of nearly half a century of precedent to the contrary. This in spite of the ECFMG, ACGME, State Medical boards(vested with the task of determining qualification to practice) etc all recognizing such foreign degrees for Medical/Surgical Residency training and subsequent practice.
It was only after months of lobbying and various letters of support from medical organisations, and meetings with the USCIS by some prominent lawyers like Greg, that they relented.
If that can happen out of the blue to International physicians typically working in underserved areas. Then those of you who feel an EAD card makes you immune are living in a fantasy. Take a stand, organize better and advocate for yourself. There will likely be a narrow window later this year for us, there must be a better effort.
BTW. It took a friend of mine 7 months recently to get his EAD card. No explanation, no nothing. He did not push the issue because he was on a H1b visa, however those are the sort of things that can happen.

On September 18, 2007, a fingerprint fee biling notice for this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was mailed to you stating the reasons for the billing and the instructions to follow to submit the necessary payment. Therefore, processing of your case is suspended until we receive the necessary payment along with the billing notice we mailed to you. If you have not received this notice within 30 days of the September 18, 2007, please call Customer Service at 1-800-375-5283 for further assistance.
Does anyone know in the same boat?

Yesterday evening even my case got transferred to local USCIS office . I have LUD on my I140 for today.My daughter's case is still with old LUD.

Thats correct. What I meant was, if you're planning to come back before 04/30 then are you planning to come back with the current visa or are you planning to get the new one stamped?
Also, you don't have a date gap in your visa in the passport. I-94 expires 04/2007 and have a new 797 from 05/2007. So I think you are good. But in my case, my I-94 expires 01/2007 and I have 2 797s: one expires Jun 2007 and the other one will be from Jun 2007 to Jun 2010. So if my visa is given based on my latest 797 (3yr based on I140) then how do I enter US before Jun 2007?

Yes, as my PD is Feb 2005, this implies that the case has been pre-adjudicated as of now pending new finger prints.
My case was originally at NSC, was then send to MSC (National Benefits Center) and then was sent to local USCIS office in San Francisco where I went for an interview and then had this request for documents. The processing dates for San Francisco field office as of now for I-485 are Aug 1, 2008. So, I'm assuming that they have cleared all the cases that reached them by 31 July 2008 and that NSC sent my case file to them by 31st July 2008.
The IO who interviewed me was different than the one who has worked on my case since.
Yes, thanks for the wishes...but in this process, nothing is certain till the physical receipt of the cards, right? :)

though I agree there is no grace period however practically USCIS has not been rigid about the dates. MOST of the employers do not inform USCIS about firing of H1b. During dot com bust, USCIS has 'unofficially' said that 15-20 days are good enough (again not as a policy decision but informally). It should be avoided, however it may not be always possible, and having few days gap should not be something on which you make life or death decision.

I have been feeling sad that I have not been able to make it to the rally and after hearing about the energy, the camaraderie and the excitement you all shared I know for sure I missed out on a once in a life time oppurtunity, there will always be that sadness in me, the only comfort I have is that I tried to contribute in ways other than attending the rally.

Going to Initial Review after approval is scary but normal when you get done FP after approval. I think if you have the I-797 approval then there is nothing to worry about. If you follow a thread in tracki*t you will know that couple of people also got similar status change after FP.

A person (Indian) with green card marrying to an Indian Citizen (whether in Indian or on H1 Visa or on F1 Visa) offers no help but adds misiries to spouse and family.
Somtimes I think, it to be a pressure technique - hey now you have GC and you are unmarried - so marry American (or GC holder) and contribute to growth and well being of those who are already in US.
My 2 cents on this situation.
