Hi, here is my case information
I-485,EAD, AP applied on 24th July, RN received today,PD May 2004 EB3, I-140 already approved
2nd labor in PERM applied in early 2007, got it approved in May 2007, I-140 applied in PP in June and approved with the same PD as EB3 I-140 i.e. May 2004
Now, my attorney is going to iterfile my EB2 I-140 today and according to him, my I-485 file should be updated in 3-4 weeks. Has anybody got it done before? If yes, please share.

that you will attend the DC rally... I won't tell you if I got the receipt notice;)
(I filed my AOS on July 2 at TSC)
TSC has officially progressed to 6/30 so the July filers should now start receiving their receipt notices! But the question is, what do we do after we get them, or in the worst case, if our AOS got rejected? There is nothing you or I can do at this time... the deadline to re-submit is over on August 17th.
The root cause of the whole problem is retrogression & country caps, and unless we speak up about it in one voice, no one will do anything to fix that root cause!
So keep looking at the road as you drive, but also take a moment to look beyond the next 1 mile... where there is a traffic jam in which you and I will get stuck for the next 5 to 10 years... unless we do something about it.. together!
So, please take a break from tracking receipts, and decide how long you are willing to renew EADs and worry about following the complex AC21 rules & regulations. If you are like me and not willing to do that forever, then make up your mind and attend the DC rally!

i dont think the congressional call will help us. all they will do - the congressman's office is just talk to them on our behalf and give us the information. that is what i gathered from them. but there is no harm in trying it out as long as we dont have a problem attributing our luck to the congressman's efficiency (god only knows if their calling might have helped or on second thoughts may be even god doesnt know - come on it is uscis - they always amaze any one and everyone)

Hey Everyone,
My brother is a US citizen who has filed an I-130 for me and my family in May, 2008. We've traveled to the US on B1/B2 visas in February, 2009. The thing about it is that in the DS-156 form point "36. Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?" we've answered "No". I've had no idea at that time that it was referring to the petition for alien relative. Anyways, we've returned back home in time. Also, I've had 3 visas before (2 tourist and 1 student) and never violated any immigration laws.
Then in December, 2009 we've applied for F-1 visa and got denied. This time it was a DS-160 form that we filled out which replaced the old DS-156 form. It didn't have that question about the petition anymore. I think they've decided to exclude it because a lot of people were confused by it. Anyways, the consulate officer didn't like the fact that I haven't transferred my credits from 2 courses of University that I've completed in my home country. Plus my major differed from my previous education course.
So my question is. Is it ok to apply for F-1 visa while I-130 is pending? I mean we've been issued B1/B2 visas before. Even though we've answered "No" to that question, they saw that I had a brother in the US who is a US citizen. I'm thinking of transferring my credits and using same major course this time or at least similar. This way in the eyes of the consulate officer it will look as I am going to the US to finish my education. The thing is, I am planning to attend community college first in order to finish general courses and then transfer to the university. My major in my home university was physics and this community college doesn't have it. I may go with "general education" course at the community college and explain to the consulate officer my situation.

There was a problem in the first two of seven D70s I've used. The focus calibration was off by about a tenth of a millimeter. This means that your images will not be focused on your subject, but instead on something somewhat behind your subject. Don't confuse this with the common mistake of having selected the wrong AF area or otherwise pointing the AF sensor to the side of your subject. Nikon of course will adjust this under warranty if it's a problem. With common f/3.5 and slower lenses it's not much of a problem, and at regular shooting apertures of f/8 or so its completely invisible. Some people incorrectly call this the "backfocus" problem.
On the other hand, if you have fast lenses that alone cost more than the complete D70 kit and you shoot them wide open you ought to check your camera. My $1,700 28mm f/1.4 lens (http://www.kenrockwell.com/nikon/2814af.htm) wide open at f/1.4 was useless on two cameras, but of course OK at normal apertures. You won't see this through the finder. You have to look at the images at 100% on your computer. It's simply the image being focused on something just a little behind where it should have, which is usually invisible if you have enough depth of field, and of course Nikon will stand behind it if it really is a problem. The samples I've used in May 2004 now seem AOK and mine is perfect, even at f/1.4.
Heck, my D70 focused better than any other camera I've owned, even with my f/1.4 lenses.
Testing this is simple. Just go make at least a dozen photos with your lens wide open and look at the results at 100% on your computer. See if the camera really focused where it should have. If you haven't done this kind of test before there's the potential that your technique may be off and not looked for it before, but you get the idea. The only concern here is that you need to have the focus be where you put it.
This miscalibration is the reason some people think their D70 images are soft. They aren't soft; they simply are focused on the wrong thing!
If your camera is out of adjustment, which I only saw on some of the very first samples, of course it's covered under warranty. If you are crazy, like this guy here (http://dvdhelp.narod.ru/D70_back_focus.html) (look out, it's a slow loading page), you can use a nail to mess it up further and void your warranty at the same time. I don't have this much guts; the D70 has a year warranty and I know your camera isn't that old! On the other hand, I respect his innovative spirit and it's this pioneering spirit which makes him an honorary American as far as I'm concerned. Please use a real Allen wrench to make these adjustments, and remember that Nikon will do it correctly for you for free under warranty and probably clean your camera as well at the same time!

I never thought registering on IV is a an issue. I see close to 50K registered users on IV, I have not come across anyone who had any issues for registering with IV.

I surely may have missed something here. Has been a bill placed already that will allow us to file 485 and get EAD?
Sorry, I am really having tough time coming to IV these days.
Its law the day when it is signed by the president unless there is clause in the bill to postpone the impelmentation.

Thank you for your advice. My last M.Sc. and Ph.D. is from the USA. My Ph.D. is about manufacturing of aircraft brakes with Honeywell.
EB1-B or EB-2 is more suitable for me?
what bothers me is that I am not cited in the literature yet and I do not have awards.

Since you have a PhD and reserach in Aircraft Braking Systems, which can be argued as aircraft safety and in national interest, you may qualify for NIW. It all depends upon you how well you argue your case as NIW and how good are your recommendations and support documentations. You need to get your papers published in reputed Journals and also get onboard of journal publication evaluations.
You also need a good lawyer (however you will end up doing 90% of work because of your unique field of research). However I would not recommend Murthy or Rajiv, because NIW is not their speciality. You need to go to a lawyers who have NIW and EB1 as speciality.
EB1 is not a good category for you, as of now, but it may change depending on your career progress.

Hello Everyone,
Hi I am a student in United States and I was on Optional Practical Training from Jan 2008 to Dec 2008. As I finished my OPT in Dec 2008 I joined again in New course for M.S in soft. Eng.
In the month of November I got a job in California through an employer, who is based in New Jersey. As I got a job the employer asked me to sign a contract which states that I will be paid 60,000 per year and I shouldn't work with his clients for 1 year after the agreement is terminated.
As the project was only for 40 days I finished it successfully and I my employer couldnt find me another job till now. So I decided to work on my own when I got an opportunity with the previously worked vendor, when my employer came to know about this he has threatened me to sue me. Then I retrieved from the opportunity but now even my employer doesnt pay me anything. It is been 4 months, he hasn't paid me anything , even he hasnt provided me any insurance.
I asked my employer couple of times to terminate my agreement otherwise I would go to Department of Labor and claim my wages but he downplays that by saying I am not on H1B so I will not be paid unless I am working with Client. But the agreement didn't say anything like that.
I have even asked him to run the payroll where I worked .I.e in California but he ran it in New Jersey. When I pointed this to him he said the payroll will be run at the residing state if the employee works more than 6 months.
We had an argument about this but he never replies to my emails he only calls me and says whatever he wants to say but when I ask him to put whatever he has said to me on phone in an email he doesnt reply at all.
And to mention, he doesnt have any documents of mine. I even didnt fill any I9 form, what ever he has is the only agreement that I signed and social security number that I emailed him to run my pay roll.
After the argument I even requested him to send my original agreement signed by two parties. I only had the agreement signed by me, he even didnt send me the agreement with his sign on it even after repeated requests.
Now he doesnt even care to answer my calls or emails. I am really tensed. I am getting opportunities from vendor that I worked with but I am afraid he would sue me. Please help me What to do. I am really really frustrated, tensed and I can't express how I feel right now.
I want to get out of the contract and work with the vendor if Possible.
Please explain me how can I tackle this problem?

I-140 PP is only available if you are within 60 days of your H-1 capout. So for most people who are porting PD from EB3 to EB2 , there is additional wait of six months to an year just for I-140.
Porting PD from EB3 to EB2 can easily take 1 year including new PERM application, I-140 and I-485 interfile.
What is interfile ? Is it changing the underlying I140 for the 485 application ?
Can we do that ?

The USCIS has not taken any official position on whether they would allow the after I-140 3-year extension to be transferred to another employer.
Using this loophole looks like many of us have actually sucessfully tranferred the H1B to a new employer after the 6 year limit..
As long as USCIS does not release any regulations...We can do this ....
If asked officialy some attorneys say that it cannot be done and some are fine with that...
Immigration laws are kind of applied sporadically and can be pushed to a certain extent

I got my FP done on 11/21.I did open a SR on 10/05, based on which I got my FP notice on 11/06.
My details:
485 filed at NSC on July 6th
Receipting done by CSC on 09/05, EAD and AP sent by CSC
485 pending at NSC
Looks like they have started the FPs for transferred cases like ours...

No I did not. The instructions said, I don't have to send photos.
That is the reason, they asked me to appear for bio-metrics which I did.
