Dear President-elect and transition team,
I am really excited by the change and new hope your administration is promising.
My story is of a bright engineering student from India, who came to USA to study a graduate degree from one of the top engineering schools in USA. I graduated with a 3.6 GPA with a Masters degree In Computer Engineering and Electrical Engineering from top 10 engineering school, University of Southern California in 2004.
I immediately joined a company, working in the Health care industry and providing software for many of the most large and research labs in the country, providing patient care to all parts of the country.
We applied for a Permanent Residence visa in the Employment Based Second (EB2) category. I have not missed a single paycheck since nearly 4 years, paid all my taxes in February 2nd week latest each year. I have studied in a premier school of USA and contributed to research and studies for nearly 3 and half years there.
There is a huge backlog of visas in the employment based categories. The backlog is in hundreds of thousands. There is a limitation of 120,000 visas each year, with a limitation of around 8400 visas for countries. This means countries like India and China which contribute the most to legal employment based immigration look at a wait of 6 to 10 years. In this time, we cannot take career decisions, are afraid to buy houses, are afraid to invest in 401k and retirement schemes, all life decisions come to a halt.
During the past years, a lot of visa numbers were left uncaptured because of processing delays. Also, family numbers count for single visa numbers. And there is a per country numerical limitation which is unfair to countries like India or China. There is no consideration for applicants with graduate and PhD degrees in Science, Engineering or Math.
Generally the illegal immigration gets all the focus, with us, legal immigrants, not even getting a mention. H1 visa category is chastised and in bad press, but we are all but a very few number of intending immigrants, who instead of taking jobs, are contributing to economy, legally residing and want to be a part of the great country. Many bills HR 5882, HR 5921 & HR 6039 are already in government waiting for action.

These before Nov2001 applicants reasons could be labor substitution (LS) or stuck in FBI/NC or other GC initiating/140 marriage delays...and therefore got a chance to apply in June/July'07 fiasco..along with their spouses..

I am not sure if its legal or not but various members can contribute their skills in exchange of donation to IV. This way members with skills are giving their time to IV and Members of the forum are getting sound advice/guidance/service for small contribution to IV. Examples can be many like CPA, Tax preparation, Doctors, career guidance, Online tutoring, Software consutlancy. I am sure all the members are "SKILLED" in various walks of life.

I have talked to IMG sales rep, he said they won't cover for pre existing conditions. He also said that as far as his knowledge is concerned there is no company out there that covers pre existing conditions when I asked him about it.
My final assumption is that any insurance we buy anywhere, just covers illnesses that are developed after the coverage starts.
Any corrections??

I had called the congressman from my district (Peter Visclosky) along with the other representatives on the list a few weeks ago. His office had taken my name and address at that time. Today I was surprised to see a letter in mail regarding that conversation and his intention to support the immigration bills in house. So it looks like that the messages we leave with congressional staffers who attend the phones do pass on the message to congressmen.

In the end it comes downs to your risk profile and expected rate of return. For example Gold is supposedly safe, but is this a good time to buy ? It is at an all time high (Around $850-900 an ounce. It was around $250 an ounce in 2000). Will it go further up, most probably, but nobody can say how much. Will it come down - you bet.
My take is - all the things in the list are vehicles of diversification. In a portfolio you should have some gold, real estate, stocks, bonds etc. and you need to constantly re-balance your portfolio as per your situation.
Also, if like most people, you don't know how to time the market, dollar-cost averaging is a good option. If you want to add gold to your portfolio, don't buy all of it today. Buy it at intervals - a friend of mine had a very good way to do it. He bought a gold coin at every family occasion - Birthday, Anniversary etc.

Thats a very good point , If they dont count the dependents in Family based category , why are they counting in Employment Based category . Again may be rules are different but we can defiently raise this question

I think this is a valid point. We should request from USCIS to treat the employment base category same as other category. I am not sure that USCIS could fix this by themselves or they need any legislation.
This will be a big relief for us and will fix our 50% backlog.

Yes many employer will open a new company but given a choice to follow the law or open a new company and start from scratch; I am sure most will follow the law. Also how many new companies will they open. If everybody files a complaint every time someone is exploited the employer will have to either stop exploiting or stop doing business.
Just because your employer is willing to steal your money does not mean you let them do it. Just because a person is ready to make you a slave does not mean you should become a slave. Let them do what they want to do, we all should do what is right and what we have to do.

There is a rumor going around now. One of my colleagues here claims that he got a call from his attorney that there is going to be a new bulletin for july, released either tomorrow or on Monday. Can someone talk to their attorney and confirm this?
I'm unable to reach my attorney now.
Nobody knows anything - this is just a rumor for now. Though I love to see it be true, I dont think it will happen. Re-reversing the visa bulletin will get more attention than the original reversing and USCIS might try to avoid that. But after JULY 2nd I wont get surprised with anything now (regarding visa bulletins and USCIS's stupidity).

I completely agree with Logiclife and the goals IV has setforth to solve our problems. There is only so much one can achieve with limited resources under which IV operates.
We need to have a set of priorities and work on that one step at time. Though I have not been to DC, I can understand what IV is going through to get us some relief. The least I can do is contribute for our cause and thats what I am doing right now.
I wish people had some common sense and better understanding of the bigger picture(& issues) before they get involved in finger pointing and asking for more.
Everyone, please be patient and support IV whole heartedly and financially so that we can atleast attempt to fix the broken immigration system. Though I am VERY optimistic that we will achieve our goals in the near future, but I would not regret even once, if we failed. It is better to try and fail than not give it a shot at all.
I fully agree , stay focused on the agreed agenda for now.
Ideal world or Dream World , one may wish to have GC along with SSN card itself , but reality right now fix is needed for the broken system called retro.

Unfortunately, this situation is analogous to riding into a starving town and waving your loaf of cake (bread = GC, cake = USCzip) at the hungry and the poor.
How do you think it is going to make an EB3 feel who has been here just about as much time as you have been but is still waiting for his date to get current so he can expect some action?
When people here report their GC approval they do it because it helps others who are waiting know what their filing dates, PD, etc was.

To raaj2007, just getting an EAD does not nullify your H1, but if you use EAD you loose H1. Go and check with your attorney. If you use EAD you cannot enter US using H1 or H4, you have to use Advance parole.

(i) I heard after filing 485 I could change employers? Yes or no? If yes, then which state would I be in? (EAD, AP or none)?
Answer - You can change employer after 180 days of pending 485 using AC 21 and you would be in EAD and use AP to enter US
(ii) After filing 485, do I HAVE to get my wife into US before the dates retrogress again?? Whoa never heard that...are you sure?
Answer -Yes, if you dont, you would not be able to file for her if the dates retrogresses again, also to file 485 for your wife , she should be in US at the time of filing 485.
(iii) Is there no step after 485 filing that I can keep postponing to not let 485 approve (like delaying 485 fingerprinting multiple times) so that I can let 485 approve only after I am married and can bring my wife in?
Answer - No, you cannot postpone it on your own will. But if your marriage date is before 485 approval (even one day) and tour wife could not make it to US, she can come to US using follow to join process. That process is also available if PD are current. In that scenario you ask USCIS to send US consulate in India to send a notice that the principal applicant's 485 has been approved and since the marriage was before 485 approval, she should be called for Interview at the US consulate in India and given the immigrant VISA, The Follow to join process is like Consular Processing.
