It is not true that all the H1bs are creating jobs. For one example I worked in a big garment company and they laid off hundreds of people(around 800) 4 years back and did offshoring 90% with 10% H1b and L1 to Infosys. This would have created less than 10 new admin jobs for setting up office here but it displaced 800 jobs plus all the new projects(jobs) go to Infosys and US government lost millions in taxes for a private company to save a few million dollars. But if a H1b is a real innovator or investor then he could create scores of new jobs but those guys are very less. They should be identified and rewarded by faster GC process.
But real intention of H1b when it was created was to fill shortage of skills but not for competing with citizens in rate. If the real intention is to compete globally then that needs to be revealed while lobbying with Senators. There is nothing wrong with immigrants or H1b persons. Most abuses are done and enouraged by employers. Corporations prefers a person always to be in H1b so they want more H1b quota and less gc so that they can exploit people.
Basically H1b numbers and offshoring needs to be increased when demand is high(Really it was needed on 1999 and 2000) and it needs to be decreased when demand is low. Also today also there is shortage of skills in a few areas. System should handle those also.

Thanks for the replies fellas, this isn't a renewal I am talking about. This is the first time I have applied for an EAD. BTW, does anyone know what's involved in converting from H4 to EAD status i.e.
1. Do you need to apply for SSN before you take a job offer?
A. Yes, you can not start working w/o a SSN
2. EAD by itself is enough to accept employment?
A. No, refer to 1
3. Can you take jobs/resign as and when you please or do you have to somehow get back to H4 status if you quit job on EAD?
A. You can work wherever you want to.

What will you do, in EB3 shoes, if the numbers are not moving in 2-3 months. You got it. MOst of them will change to EB2, right. I will too. I am sure you can imagine the scene then. I know 8 of my 15 friends have already jumped to EB2. And I am sure they have much higher priority date than most of EB2s there. So you know what to expect. Lets ALL support for the common cause.

I understand the frustration. Until two months back my PD was retro. Now, I already have my GC on my EB2-NIW I-140 and also had an approved EB1-OR I-140 recently. I am not here to suggest anyone shouldn't do what they think is best for them.
My own understanding of the law is that EB1 gets the left over EB5, EB2 gets the unused numbers from EB1 and the EB5 that went into EB1 but unused. EB3 gets the unused numbers from EB2 and those from EB1+EB5 unused by EB2. This maintains the preference categories (USCIS's definition, I am not saying EB2 is better than EB3).
No matter how the numbers are distributed, there is more demand than supply. It is unlikely all the unused EB1 and EB2 ROW numbers would fall to EB3 ROW and then to EB3-C/I. Some would surely go to EB2-C/I. Right now everyone is retro except EB1 and EB2 ROW. So, redistribution doesn't fix the problem just redistributes the retrogression.
If we can get the recapture and elimination of country ceiling then everybody benefits. The fact that we have an immigration bill is in itself quite something.
No matter how USCIS or DOS allocates the numbers, there will be backlog and its in everyone's interest whether C/I or ROW to think about pushing for the immigration reform bills.

You basically get an I131 which has all your immi information on it. It also includes your photo and validity period. There is also an area for stamping it when you re-enter the country. I hope this helps.

I recharged my account 10 days back at aitell 9.99 for 600 mins valid for 45 days. Today not allowing to make call due to insufficient balance. From the call history on their website, I only used 300+ minutes after recharge. I got doubt and looked all my recharges and usage from last 3 months. They are giving less minutes than advertisements on their website. I called to check with them today and customer service number is always busy. Any body using Airtel check your account history.
I had similar issue with them yesterday and also lost minutes, I tried to reach them for at least 90 minutes, finally I am able to get in touch with customer service rep and she confirmed me that they are running into some issues that they said that technical upgrade and confirmed me that after 2 hours I will get my minutes back (After that upgrade)...I have checked and it came back......
so speak with them, I am sure you will get yours back.....good luck

Our priority date is April 2006 and we'd received a RFE in 2009 which we'd responded in June 2009, however, still no update on our case status.
I'd opened a SR, send an email to Nebraska service center and also approached my local senator/congressman, but no update as of yet and just the standard reply.
What to do to expediate? We've been current for more than a month now! :(

I don't have H1 backup and already in 8th year. I am on self employment, But my lawyer suggested to apply H1extension (through my company) as a backup if MTR denied. If MTR are successful they I don't have to go on through H1 hassle again..
what is the thoughts/advise of your lawyer on EAD status? Before H1 is available (if at all in your case) can you continue working on EAD?

Isn't it part of her job? There is nothing like being servant. Moreover, it was just asked to rinse the bottle with hot water, to be sure it is hygenic, in a circumstances when baby was making tantrums. Another reason for asking was because bathrooms were full, otherwise there wouldn't have been a need. We have travelled many other airlines, and there was never an issue for such requests. Many airlines go extra mile to please you. It is what is called customer service.
I don't understand why is it hard or degrading? Maybe then they are not supposed to serve you a cool cup of water at your seat as well. Is that demeaning as well on part of her job?

She has two duties on the plane, in order:
- safety of the passengers. this is #1.(ensuring luggage is stowed, seatbeats are on, people are not wandering around the aisles; co-ordinate and help in case of emergencies)
- basic service (serve food, clear the trays, handle simple requests like juice/water, ice barfbags etc). This does not include cleaning out your babies bottles. Some airlines have stewardesses who would go out of their way (I have seen Singapore Airlines do this) but again, rinsing a baby's bottle is NOT part of her job. She can get you a bottle of hot water if you want and you can rinse it yourself either in the sink or into the barf-bag.

My name on the birth certificate is "girl". What should I do correct it. I was reading on the forums, that we can get a written statement saying that the name was not decided when I was born. And submit that along with high school mark sheets etc. Are there any other things that could rectify this error.

Our limitations 1) Till we interfile we have to show us fulfilling EB3 job calssification related obligations ( that also is a "future" postion in reality). Now if EB2 application is from "same employer" then that employer can logically produce the letter matching EB2 level experience after "real and natural skill progression" only to prove that you are fit for more advanced skill level job in other words after wait for 2-3 years.

I know this topic has been thoroughly disussed above but still would appreciate some response to help me for my situation:
My husband has filed under EB3 category(chargeability India) and has a PD of Oct06. I-140 is pending and we have filed for I-485 (husband primary and me dependent), EAD and AP.
I have filed my GC on July9th and have an approved labor, and am planning to file my I-140 and I-485 as I have a charegability of Iraq.
My question is if I do file I-485 as the primary and make my husband the dependent on the application, do I still need to provide the A# number we received from his I-485 application receipt?
Can it have a negative impact on either of our GC application?
If we are asked to chose when will it be asked?
Please do reply and help me.
