In I-485, when we enter I-94 information, I am not sure which date to use in the valid field.
The date on my white EAD card expired already. I have a new I-797 which is valid until 2010. My guess is I should enter this date. Can any one please confirm?

all this is because of the stupid indian government.. they dont have treaties with any other country in the world... that is called visa reciprocation.
All tom, dick and harry to enter india needs a visa and hence all countries dont have that treaty...
the 2 countries tat dont need visas are St.Kitts and Nevis and jamaica....LOL

I just wrote a letter detailing my frustrations and attached with it the documents. I don't think the call was anything big deal.....it was more a courtesy call an image improving call...we were not told anything that we didn't know already.....USCIS always raised more questions than answering them.......

Well even if you use AP, you need a passport, dont you? And the passport must be with the Consulate pending stamping. So one way to get the passport back is to withdraw the visa application.
A question though: is'nt it abandoning your H1B1 visa tenure if you enter on AP even with a valid H1B remaining?

We received the snail mail welcome notice today after receiving the email ADIT stuff last Tuesday (August 10). That makes it five business days. On the notice it says that we should receive our permanent resident card within three weeks. Anybody who actually received it within three weeks?
I received it within a week...
CIS sent welcome notice on 8/2, and they sent the cards on 8/9...
But this was early Aug. Now it may take few days more due to many approvals in the pipeline..When you receive another update (like post decision activity) saying that they mailed decision notice, that usually means they mailed the cards...

Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. The fact that we could get Mr. Gonzalez to even respond to the flower campaign itself speaks that Gandhigiri has worked...the publicity that this will generate will be of immense help....

Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. Greencards do not get issued on the day date gets current. It is not a automatic process. There is lot of human work involved and many people do not understand that or spend time understanding it. They would rather waste their time either on useless task of tracking or calling customer service every single day.

Hi All,
I am on a business trip to Chennai and I was interviewed for my H1-B renewal on Dec 6th 2007, unaware of the PIMS as it was not mentioned anywhere on the website that it will take this long to receive the passport. I was granted my visa within few minutes but till date (Jan 1st, 08) I have not received my passport. Was interviewed at the Chennai consulate. It has been heights of frustration as I had to spend all my Christmas holidays and New years at Chennai with all my fly being in US. I was supposed to return to US on Dec19th had to postpone my tickets to Dec 24th and then to Dec 29th. Now finally I have cancelled my tickets as it was costing me $200 every time I modify my itinerary.The US consulate, Chennai keeps on extending the processing time from 3 to 7 to 10 and it has been 15 working days already now, but still no passport in hand. Last week on Friday (Dec 28th) got an email that it might take additional 7 working days, huh ! Good thing is my company is in Chennai so atleast I can go to work or else it would have been really painful.
Was anybody else interviewed at Chennai during that black week ??? with similar situation ?

Someone please consolidate all information and create a campaign for this. Now is the time to follow up with anybody on the full committee with whom we have previously met or been in contact. Don�t call people who are already cosponsors. Only select people in the committee that are not co-sponsors. Make sure to say that you are a member of immigration voice so that it complements our lobbying efforts.
Please pool your energies and create a list of people to call, phone numbers and what to say. Any moderator will add in the first post of this thread.
Please keep posting your feedback on the thread when you have called. Once the campaign details are posted, post them on other websites too.

FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

These assumptions marked in red are incorrect. ROW has been consolidated into 1 category to simplify the visa bulletin. ICMP countries exceed the quota, that's why they have separate entries. If another country exceeds the quota U.K. for example, then it'll have it own column in the visa bulletin. The quota for EB-ROW is 40K - per country limit for ICMP for that category X 4. That's why EB3 India has been getting screwed ever since they re-interpreted the spillover rules (in the middle of 2008). Otherwise, you would see EB3 ICMP get at least 8K GCs in 2009.
1) Each (EB1/2/3) - 28.6% WW quota = 40040
2) 5 subscription cataegories under each EB category: I,P,C,M,ROW
) Assumption - USCIS distributes equal share amon3g these 5 different subscription categories = 40040/5 =8008 in each EB category for a particular subscription category.

Does the letter need to have the same information as the LC. I can get a non I-485 related employment verification letter but here is the catch. The employer is dilly dallying on filing for I-485. The employer can give a letter with my job title which is "XYZ Developer" include salary, length of employment etc. But the "Final Determination" copy that I have says occupation: Computer Software Engineers, 15-1031. Does the letter have to state "Computer Software Engineer" or can it state "XYZ Developer" ? If it has to be the former that will only alert them that I am bypassing their stonewalling and the employer is only likely to refuse to include that as the job title. So which is which ? The job specific title ie "XYZ Developer" or the DOL title per the "Final Determination"

So far I've only seen some suggestions on other forums that suggest filing anyways without the letter and waiting for an RFE which might then coax the employer to do the necessary then, waiting for I-140 to be approved and then filing with W-2's (or paystubs -- I don't recall) or waiting 180 days, filing without the letter, switching to a new employer after the 180 days pass and then submitting the new employer's letter.
